Blaine County Arrest Records

Blaine County arrest record is an official document that provides information about the arrest of a person in the county. These documents contain information on an individual's encounter with law enforcement, including the reason for arrest and the individual's identifying information. Arrested persons and persons serving time in Blaine County are typically housed at the Blaine County Detention Center. The Blaine County Sheriff's Office is the custodian of arrest records within the county. However, one may also access arrest information from Blaine County Court Records or criminal history records.

Are Arrest Records Public in Blaine County?

Yes. Per Section 74-102 of the Idaho State Legislature, any individual has the right to view and obtain a copy of any state public record, unless a statute specifically states otherwise. However, some records which may not be available to the general public because they are exempt from disclosure include:

  • Records exempt from disclosure by federal or state law
  • Investigatory records of law enforcement agencies
  • Juvenile arrest records
  • Documents for which the public's interest in privacy, public safety, security, and rehabilitation manifestly surpasses that of disclosure
  • Victim identifying information.

Blaine County Arrest Statistics

The Idaho State Police publishes statewide arrest information. According to the Blaine County arrest statistics, with an arrest rate per 100,000 population, 616 arrests were made in the year 2023. 232 arrests were carried out for DUI offenses, with arrests for all other offenses numbering 109. Nine arrests were made for liquor law violations and there were seven arrests for trespassing.

Find Blaine County Arrest Records

The Blaine County Sheriff's Office is the principal custodian of criminal justice documents generated in the county. To look up recent arrests, one may browse through the online Detention Roster provided by the Sheriff's Office. Record seekers may also request access to public records under the FOIA. To make a request, fill out and submit the Online Request Form. Records requested may be picked up in person or sent via mail or email. Other local law enforcement agencies also make arrests in Blaine County. One may contact the Records Bureau/Unit of the police department that made the arrest to find an arrest record.

Furthermore, information regarding people who are incarcerated, on probation, or on parole, or who are currently under the jurisdiction of the Idaho Department of Corrections (IDOC), can be found in the IDOC database. To search, input the first and last name of the offender or the offender's IDOC number.

Alternatively, interested parties can use the Federal Bureau of Prisons' Federal Inmate Locator to find information about people who have been imprisoned by the FBI. Entering the offender's name or BOP registration number allows one to carry out a search.

Free Arrest Record Search in Blaine County

Anyone who wishes to conduct a Blaine County arrest record search for free may utilize the online Detention Roster maintained by the county's Sheriff's Office. One may also search the Online Database maintained by the Idaho Department of Corrections for free. Furthermore, members of the public may obtain free arrest records by utilizing the services rendered by third-party websites. These unofficial sources allow name-based searches for arrest records and a searcher may find arrest records for free. However, free records are typically limited. A charge or paid subscription may be necessary for detailed results.

How Long Do Arrests Stay on Your Record?

Most Blaine County arrest records, particularly those resulting in a conviction, are not expunged and remain on the record indefinitely. Arrest information is permanently entered into a criminal record unless it is sealed, expunged, pardoned, redacted, or dismissed. However, to qualify for these reliefs, the petitioner must meet eligibility requirements and submit an expungement application.

Expunge Blaine County Arrest Records

An expungement is the legal erasure, deletion, or otherwise rendering of criminal records inaccessible to the general public. Under Idaho Code Section 67-3004(10), only the following individuals are eligible to request for an arrest record expungement:

  • Anyone detained or served with a criminal summons who, within a year of the arrest, was not charged with a crime or given information
  • Any person who was acquitted of all offenses arising from an arrest or criminal summons
  • Anyone who has had all charges dismissed.

To have an arrest record expungement, one may begin by filling out and submitting an Expungement Application Form to the Idaho State Police (ISP). Applicants are required to provide a certified copy of a court order of acquittal that states they are not guilty of the crime charged or a court order of dismissal showing what crime(s) were dismissed. Applicants must also include copies of a criminal citation, a criminal complaint, and summons, an indictment, or information. This application may take a processing period of 30 days.

Afterward, the ISP will notify the court and the arresting agency to remove the arrest record from their records if the application is approved. Additionally, the ISD will provide a Certificate of Expungement to the person, which serves as proof of the expungement.

Blaine County Arrest Warrants

An arrest warrant is a written order signed by a magistrate, in the name of the state of Idaho, commanding the arrest of the person named in the warrant. Per Idaho Criminal Rule (I.C.R.) 4, a magistrate may issue a warrant for arrest after establishing that there's probable cause to believe a crime was committed and that the suspect committed it.

To determine probable cause, a magistrate may depend on information provided in a written affidavit or by sworn oral statement. The official may require the person providing the testimony to appear personally or examine them and the witnesses under oath. When the magistrate is satisfied that there is probable cause, a warrant commanding the law enforcement agent to arrest the defendant and bring them before a magistrate is written.

Per I.C. 19-507, the following information may be found in a Blaine County arrest warrant:

  • The county, city, or town of issue
  • The suspect's name, or a name or description through which the suspect may be identified
  • The charge brought before the suspect
  • An order to arrest the suspect
  • Date of issue
  • The office and signature of the magistrate.

Do Blaine County Arrest Warrants Expire?

No. A Blaine County arrest warrant does not expire. Under 5.0 Specific Criminal Procedures, an arrest warrant remains valid indefinitely until it has been executed. An arrest warrant may also be revoked by a judge.
