§ 19 (601) of Idaho's Criminal Procedure defines an arrest as the process by which a peace officer or a private person legally takes a person into custody, an action that may require restraint depending on the unique details of the case. Per the Law, arrests can happen in numerous circumstances, such as when a public crime was committed in an officer's presence or the officer reasonably suspects that the arrestee has committed a felony. Regardless, arrests are made to introduce a suspect into the state's criminal justice system, thereby facilitating a legal system that brings offenders to book.

In Cassia County, arrestees are often transported to the Mini-Cassia Criminal Justice Center Jail, where they are booked into jail—a process that involves collating the arrestee's information into an arrest record. The arrest record then serves as resource material for prosecutors, law enforcement agencies, lawyers, policymakers, researchers, and many more. Outside the above statutes, Idaho does not have any concrete expungement laws. However, individuals who are ineligible for expungement or shielding may request a withheld judgement. This means that the alleged offender can plead guilty to their charge and request the court not to enter a conviction. If granted, the defendant will serve their punishment as though an order of conviction was entered. However, after completing the sentencing requirements, the subject can request the court to retroactively dismiss the case. If dismissed, the individual is allowed to deny the criminal conviction. Subject to a few exceptions, a person can get only 1 withheld judgement in their lifetime.

Cassia County Arrest Warrants

Per § 19-507 of the Idaho Statutes, arrest warrants in Cassia County are written orders issued in the name of the State of Idaho by a magistrate, commanding an officer to arrest a defendant. Arrest warrants are issued based on a complaint on oath that shows probable cause that the defendant has committed an offense.
