The Idaho Court Administrative Rule 32 defines an Idaho court record as any information or document related to a court proceeding filed, docketed, or lodged by a court or clerk. It includes any record created or prepared by the court like calendar, order, index, judgment, docket, official record of the proceedings, decree, register of actions, and minute. The Clerk of the District Court is the overseer of all court records in Kootenai County and disseminates them to ensure the judicial process is transparent. Court records can be viewed online or copied by email, mail, or in person at the courthouse. Requesters should be able to see the following information in a court record:

  • Party (subject’s name, date of birth, attorney’s name)
  • Disposition events (judgment type)
  • Charge (description, citation, statute, level, and date)
  • Events and hearings (date, comment, and judicial officer)
  • Case information (case caption, number, type, and status, file date, court, and judicial officer’s name)
  • Financial (total financial assessment, total payments and credits, date, amount, and receipt number)

Are Court Records Public in Kootenai County?

Yes. Both the Idaho Public Records Act (I.C. § 74-104) and the State Court Administrative Rule 32 authorize public access to court records in Kootenai County. Therefore, citizens can examine, inspect, or copy court records in the lobby or remotely through terminals at the courthouse. The following court records are available for public perusal:

  • Trial and hearing transcripts and records

  • Litigant/party indexes to cases filed with the court

  • Affidavits or sworn testimony and records of application supporting the issuance of search or arrest warrant pending the return of the warrant
  • The names of jurors listed on a panel for a case's trial, along with the information from their jury qualification forms and jury questionnaires.
  • Records of judicial work products or drafts such as notes, memoranda, emails, or drafts created by a law clerk, judge, court-employed attorney, legal assistant, or secretary.
  • Applications submitted and orders issued for the interception of electronic, wire, or oral communications, recordings of these intercepted communications presented to the court, and reports submitted to the court concerning these interceptions.

Per I.C. §67-3001(4), criminal records are any information on Kootenai County residents collected and maintained by the Idaho state police due to arrest or the initiation of a criminal proceeding. Kootenai County Marriage and Divorce Records

The Idaho Department of Health and Welfare disseminates certified copies of marriage and divorce records filed from May 1947 to the present. Kootenai County marriage and divorce records are confidential for 50 years. Confidential Kootenai County vital records of marriage and divorce are only open to record holders. immediate family members and their legal representatives.

Kootenai Birth and Death Records

Birth and death records are not part of Kootenai County public records. Kootenai County birth records only become public after 100 years, while death records are confidential for 50 years.
